Since it's right on the border, and according to Wikipedia the freight is trucked across the border, why not just extend the railroad across the border?  Then the trucks would travel between two points, not just out and back, by rail, which should solve the legal issues.

I would assume no US Government agency would authorize the tracks construction or entry into the US
for the financial maleficent.  Jones Act/cabotage it would be a shipment originating in Canada.
